In that case, the stepparent may want to cement their legal rights and responsibilities by pursuing stepparent adoption. However, the process can seem complicated and overwhelming.

What Is Stepparent Adoption?

Adoption is a legal process that allows an adult to obtain the same rights and responsibilities for a child as a biological parent. After a successful adoption, the adopter can make significant decisions on behalf of the child involving education, healthcare, and the child’s overall well-being, just like a birth parent.

In Florida, the stepparent adoption process allows the spouse of a custodial parent to seek an adoption of their partner’s child. If approved, the stepparent becomes the legally recognized parental figure of the child and holds the same status and rights as a biological parent. The adoption process makes this relationship legally binding and permanent.

Requirements for Stepparent Adoption in Florida

Florida law outlines specific requirements that must be met for a stepparent to move forward with the adoption process. To legally adopt a stepchild in Florida, stepparents must meet the following criteria:

  • The stepparent can financially and emotionally support the child
  • The stepparent and their spouse must file a joint petition seeking adoption
  • The family must have consent from the other biological parent
  • The stepparent must be married to a biological parent of the child

First, for a stepparent to even think about starting the legal adoption process, they must be married to the child’s parent. Florida law does not allow unmarried stepparents to take advantage of the Florida stepparent adoption process.

One of the most complicated aspects of processing a stepparent adoption for Florida families is getting consent from the other biological parent. To finalize a stepparent adoption, the other biological parent must consent to the adoption. In some cases, the other parent’s parental rights can be terminated, such as in cases of abandonment. If the other parent does not consent to the adoption, they can contest or oppose the process. The court can then determine whether to terminate the biological parent’s rights based on the situation’s circumstances and whether terminating that parent’s rights is in the child’s best interest.

Florida Stepparent Adoption Process

To file a stepparent adoption, you must file an adoption petition and supporting documentation in the county where you currently live. You must complete the petition thoroughly and accurately. An experienced attorney can help you with it to facilitate a smooth adoption process.

A skilled attorney can also help prepare you and your family for the next step in the adoption process if the court requires a home study. Home studies are not required for stepparent or grandparent adoptions unless there is good cause to show that one is necessary.

If you meet Florida’s requirements, the court schedules a hearing. A judge reviews the case at the final hearing and issues a Final Judgment of Stepparent Adoption. Once finalized, parents can change the child’s birth certificate and include the stepparent’s name.
